These Terms of Use (hereinafter referred to as the "Terms of Use") This Terms of Use (hereinafter referred to as the "Terms") applies to all users (hereinafter referred to as "Users") of the EV on-demand bus transportation service (hereinafter referred to as the "Service") operated and provided by MHI as part of the demonstration experiment. (hereinafter referred to as "the Company"), operated and provided by the Company in the demonstration experiment (hereinafter referred to as "the Service"). (hereinafter referred to as "Users").
These Terms of Use define the terms and conditions of provision of the Service, the method of use, and other incidental terms and conditions, and apply between the user and the Company.
When a user downloads and installs this application on his/her smartphone or other compatible device and logs in according to the method designated by the Company, he/she is deemed to have agreed to these Terms of Use, and a contract (hereinafter referred to as the "User Agreement") is established between the Company and the user, which includes these Terms of Use. The contract (hereinafter referred to as the "User Agreement") between the Company and the user shall be deemed to be formed.
The Company reserves the right to change the Terms of Use. In such cases, the Company shall clearly indicate the details of the changes and the effective date of the changes, and shall notify the users by appropriate means. After the effective date, the revised Terms of Use shall apply even to reservations made before the effective date.
This service provides transportation to and from users using private vehicles owned or managed by the Company, and is not subject to the regulations and obligations of the passenger motor vehicle transportation business as set forth in the Road Transportation Law.
The Company may terminate provision of the Service without notice to the user. In the event that provision of the Service is terminated, the Subscriber Agreement will be terminated at the same time as the Service is terminated.
We may temporarily suspend the provision of the Service or the Application without notice to users in any of the following cases
(1) For periodic or emergency system maintenance of this application
(2)When this service cannot be provided due to fire, power outage, incident, accident, epidemic of infectious disease, war, riot, disturbance, labor dispute, etc.
(3) In the event that this service cannot be provided due to an earthquake, eruption, flood, tsunami, or other natural disaster.
(4)In the event of outage or failure of the communication service or server used for this application
(5)When communication failure occurs due to the usage environment of the terminal compatible with this application or other circumstances
(6) When the provider of this application deems it necessary to temporarily suspend the provision of this application for operational or technical reasons
(7)When a provider of other goods or services necessary for the provision of this service deems it necessary to temporarily suspend the provision of said goods or services.
(8) If the provision of this Application or the Services is interfered with due to the enactment, amendment, or repeal of laws or ordinances, or the publication or change of interpretations of laws and ordinances, etc.
When notifying users of the temporary suspension of this application or when notifying users of the suspension, we will notify them by any method that we deem appropriate. However, this does not apply in the case of an emergency or when notification cannot be made due to unavoidable circumstances.
The following terms are used in these Terms and Conditions with the following meanings
(1) Carrier
means a business operator to which MISUMI consigns the operation of EV on-demand buses.
(2) Transportation services
means actual transportation and related procedures performed by an EV on-demand bus operated by an operator.
(3) Boarding and alighting locations
(2) "Point" means a location within the transportation service area where users can board or alight from the EV on-demand bus, and which is set up in advance by the Company.
(4) This application
means application software for smartphones designed and provided for users in connection with the Company's provision of functions for accepting reservations for transportation services, etc. to users.
(5) This content
(2) "Service" means a generic term for text, sound, still images, moving images, software programs, code, etc. (including information posted) provided on the Service. (including posted information).
(6) Personal information
Personal Information" as defined in Article 2, Paragraph 1 of the Act on the Protection of Personal Information as information that can identify an individual, such as name, date of birth, gender, address, telephone number, account ID, password, e-mail address, and survey response information.
(7) Registration information
The generic term for information (including personal information) registered by the user in this application. (including personal information) registered by the user in the Application.
(8)Supported terminals
(2) "Service" means a generic term for smartphones, tablets, and other information terminals that enable users to download this application and use the Service.
(9) Registered terminals
The generic term for the compatible terminal on which the user has registered as a user of the Service.
(10) EV on-demand bus
A bus that is dispatched when a user makes a reservation for a bus dispatch through the Application.
(1) Provision of transportation services
The user may request the provision of transportation services (hereinafter referred to as "request for provision") by the method set forth in 11.1 (1) and (2). (1) (2) of 11. Upon receiving a "request for provision" from a user, we shall proceed with the procedures for provision of transportation services and instruct the carrier to provide the transportation services.
(2) Prohibitions on requests for transportation services
Users shall not make provision requests that fall under any of the following items.
(a) Request for provision to any place other than the boarding and alighting places designated by the Company (b) Request for provision in a manner that violates these Terms and Conditions
(c) Multiple provision requests (meaning that the same user makes multiple conflicting provision requests during substantially the same time period) (c) Duplicate provision requests (i.e., multiple conflicting provision requests by the same user at substantially the same time)
(d) Requests for provision containing false information
(e) Other requests for provision that the Company deems inappropriate.
(3) Suspension of transportation services
We or the carrier may not be able to provide transportation service in the following cases
(a) When a vehicle that meets the user's desired riding conditions cannot be arranged
(b) When there are practically no vehicles available for dispatch, such as just before the end of business hours or when there is a concentration of use by other users.
(c) If the User has violated or is likely to violate these Terms and Conditions
(d) When the EV on-demand bus service should be suspended at the discretion of the Company or the carrier for any reason
(e) Other cases in which system circumstances make it difficult to provide appropriate transportation service procedures.
(1) Method of requesting transportation services
(a) Request for provision by app.
Users can request the provision of transportation services by entering the necessary information on the screen displayed on this application, including the place of departure, destination, number of passengers, additional information, ride classification, and date and time of the ride by themselves.
The user selects the point of departure and destination from the boarding and disembarking locations predetermined by the Company at the time of the provision request.
(2) Types of requests for transportation services
(a) Reservations for immediate use
The User may use the transportation service immediately after the request for provision, insofar as EV On Demand Bus Arrangement is available.
(b) Advance Reservations
Users may use the transportation service by specifying the date and time they wish to board the EV on Demand Bus, regardless of the EV on Demand Bus's hours of operation, and may make reservations up to three days in advance of the desired date.
(3) Communication costs for the user terminal related to the transportation service provision request shall be borne by the user.
(1) Procedures for providing transportation services
Based on the user's request for provision of transportation services, SBM will implement the procedures for reservation of vehicle allocation for the provision of transportation services.(2) Formation of car allocation reservations and notification of car allocation reservation information
(1) We will notify the user of the place of boarding and alighting, scheduled time of boarding, scheduled time of alighting, etc. (hereinafter referred to as "vehicle dispatch reservation information"). The Company shall notify the user of the location of boarding and disembarking, scheduled time of boarding, scheduled time of disembarking, etc. (hereinafter referred to as "reservation information") by one of the following methods specified by the Company. The vehicle reservation shall be considered to be established at the time such notification is made.

(1) Cancellation of reservations
If a user wishes to cancel a vehicle reservation after the reservation has been made by making a request for transportation services, the user shall cancel the reservation by the same method used at the time of the reservation, by the scheduled vehicle arrival time indicated when the user is notified of the vehicle reservation information.
(2) Change of reservation
If the user wishes to change a vehicle reservation after the reservation has been made by making a request for transportation services, the user shall cancel the reservation by the same method used for the reservation and then make a new reservation by the scheduled vehicle arrival time indicated when the user is notified of the vehicle reservation information. The cancellation procedure shall be made by the same method used at the time of the reservation and the reservation procedure shall be made again. Only a change in the number of persons can be made without the need to cancel the reservation.
(3) Notes on rebooking
(ii) A request for the provision of transportation service again (including another reservation procedure after cancellation of a reservation made for the purpose of changing a reservation based on the preceding item) (including the case where the reservation is cancelled due to a change of reservation based on the preceding item) depends on the situation at the time of the request, and we shall not be liable for any damage incurred by the user as a result of the reservation not being made based on such a request.

(3) When a user has been assigned a vehicle in accordance with Sections 11.1 and 11.2, the user shall go to the designated boarding location by the scheduled arrival time of the vehicle and be ready to board the vehicle. If the user does not show up by the scheduled arrival time of the vehicle and is unable to board the vehicle, the user shall not raise any objection, and neither Peach nor the carrier shall be liable for any loss or damage incurred by the user as a result of such failure.
(2)Identification when boarding
When boarding the arranged vehicle, the user must provide the driver of the vehicle with a reservation number (usually the last four digits of the cell phone number reported as application information at the time of the request for the relevant transportation service) in order for the operator to confirm that the person who is boarding the vehicle is the person who requested the dispatch of the vehicle (the user) in question. The driver of the vehicle will be required to provide the following information.
(3) Scheduled vehicle operation time
The vehicle may not be able to operate according to the scheduled embarkation and disembarkation times notified as reservation information at the time of the request for transportation service, based on traffic conditions on the road and other reservation conditions.
(4) Bringing in hand-circulated goods
In addition to their personal belongings, users may bring into the company personal effects within the limits listed below.
(a) Goods with a gross weight of 10 kilograms or less
(b) Articles the sum of the length, width, and height of which does not exceed 120 centimeters
(c) Articles not exceeding 100 centimeters in length
(5) Carry-on baggage
By entering the number of baggage items when making a provision request through this application, the user may bring baggage within the limits listed below into the company.
(a) Goods with a gross weight of 20 kilograms or less
(b) Articles the sum of the length, width, and height of which does not exceed 160 centimeters
(c) Articles not exceeding 100 centimeters in length
(6) Restrictions on personal effects and baggage
(b) Notwithstanding 14.(4) and (5) above, Users may not bring into the Company any knives or other articles prohibited from being brought into the Company pursuant to the provisions of the Regulations on the Transport of Passenger Vehicles.
(b) When we and the Carrier deem that there is a possibility that the Passenger's Baggage may contain any of the items referred to in 14.(6)(a), we may request the Passenger to clearly indicate the contents of his/her Baggage and Baggage.
(c) NCA and the Carrier may refuse to carry in their hand baggage and baggage to a Passenger who does not comply with the request pursuant to the provisions of paragraph (6)(b) of Article 14.
(d) In the event that the Passenger complies with the request pursuant to the provisions of 14.(6)(b), if the Baggage and Baggage are similar to, and difficult to identify as, the articles referred to in 14.(6)(a), NCA and the Carrier may refuse to accept such Baggage and Baggage unless the Passenger provides reasonable proof that such Baggage and Baggage are not such articles. (2) The airport may refuse to accept such articles and baggage unless the passenger can provide reasonable proof that they are not such articles.
(7) Change of drop-off location not allowed
After boarding a dispatched vehicle, the user may not drop off the vehicle at a location other than the drop-off location notified to the user as part of the vehicle dispatch reservation information, except in the case of an emergency, etc. The user may not change the location of the drop-off location.
(1) Outsourcing of transportation services
In this service, the operation of the vehicle to which allocation has been made will be performed by a carrier (listed in the attached table) to which MISUMI entrusts its operations.
(2) Transfer of transportation services
The user shall, at his/her own responsibility, receive such transportation service from such carrier in accordance with the Conditions of Carriage stipulated by such carrier.
(3) Responsibility for problems in transportation services
We shall not be liable for any problems inherent in the actual transportation service provided by the carrier to the user, such as problems arising from the operation of the EV on Demand Bus, unless such problems are caused by our intentional or negligent conduct.
(1) Liability for third-party use
A person who requests the provision of transportation services through this application (hereinafter referred to as the "requester") and the person receiving the transportation service (hereinafter referred to as "passenger") are different (hereinafter referred to as "third party use") (hereinafter referred to as "Third Party Use"). The requester shall make the passenger agree to these Terms and Conditions in advance, and shall be jointly and severally liable with the passenger for any violation of these Terms and Conditions by the passenger and for any other liability arising from the passenger's provision of the transportation service for the dispatch of the vehicle in question.
(2) Obligation to use third parties
In the event of third-party use, the requester shall, at its own responsibility, communicate the details of the vehicle reservation information notified in accordance with 12.1 (1) and (2) to the passenger without omission, so that the passenger can receive the transportation service without delay.
(1) Nature of services
This service is a demonstration experiment, and we make no warranties of any kind, including warranties regarding the timeliness, safety, accuracy, optimality of routes, fitness for a particular purpose, and commercial usefulness of the dispatch arrangements and covered transportation services, etc. We also disclaim any and all liability arising from the use or non-use of the Service and the Application and their use or non-use, except in cases of our willful misconduct or negligence.
(2)Use of this Application, the Service and the Transportation Service
In the event of any of the following events, the Application, the Service, or the transportation service cannot be used in whole or in part, and we shall not be liable for any damage or loss incurred by the user or a third party as a result thereof, unless such damage or loss is caused by our intentional or negligent act.
(a) If there is an error in the information reported by the user
(b) When this application-compatible terminal or other peripheral equipment, etc. is not properly installed or connected, or when it does not operate properly due to malfunction, damage, defect, etc., or when it is incompatible with any combination of these, or when it has functional settings that impair the use of this service
(c) Failure to comply with the items described in the instruction manuals, etc. for the handset or other peripheral devices compatible with this application.
(d) When power is not normally supplied to the handset or other peripheral devices, such as when the battery of the handset compatible with this Application runs out, etc.
(e) When the power of this application-compatible terminal or other peripheral devices, etc. is not turned on.
(f) When the contents of the various functions available to the user differ depending on the handset compatible with this application, whether or not the OS of the handset compatible with this application has been upgraded, etc.
(g) In the event of any other unauthorized operation, etc., by the user.
(3) Provision of transportation services
The scheduled time of boarding and scheduled time of disembarkation of a vehicle in the vehicle reservation information based on (1) and (2) above is subject to the reservation status of other users, weather, road conditions, and other circumstances beyond the control of Nissan and the carrier, and no guarantee is made that a vehicle will be dispatched at the time stated in the vehicle reservation notice. No guarantee is made that a car will be dispatched at the time indicated in the dispatch reservation notice.
(4) Boarding and alighting locations
The boarding and alighting areas designated by the Company are subject to change or deletion without prior notice. In addition, there may be steps or other points at the embarkation and disembarkation points that require caution when boarding or disembarking. Neither Nissan nor the carrier shall be liable for any damage incurred by the passenger due to stumbling over steps or other conditions at the boarding and disembarking points.
(5) Circulars, etc.
Except in the case of willful misconduct or negligence on our part, neither we nor the carrier shall be liable for any damage or loss incurred by the user due to loss, damage, defacement, loss, theft, etc. of the user's personal effects, clothing, glasses, watch, or other personal belongings. Neither NCA nor the carrier shall be liable for any damage or loss incurred by a third party due to the user's personal effects, etc., nor for any damage or loss incurred by the user due to the personal effects, etc., of another user.
(6) Violations or errors by the user
In the event that a user's request for transportation services violates these Terms and Conditions, or the user is unable to use transportation services due to a mistake in the request for transportation services or other reasons attributable to the user or others, neither we nor the carrier shall be liable for any damages incurred by the user as a result of such violation. We and the carrier shall not be liable for any loss or damage incurred by the user as a result of such failure.
(7)Disputes not attributable to the Company
In the event of a dispute between a user and a carrier or other third party, the dispute shall be resolved between the user and such party, and the user shall not file any claim or complaint with us.
(8) Limitation of liability
Unless the Company is willful or grossly negligent, the Company shall not be liable for any damages, including lost profits, damages arising from special circumstances (including cases where the Company foresaw or could have foreseen the occurrence of damages), and damages based on claims for compensation from third parties, incurred by users in connection with the use of the Service or these Terms and Conditions, including the following items. and any damages, including damages based on a claim for compensation from a third party.
(a) Maintenance
(b) Natural disasters such as earthquakes, typhoons, floods, storms, heavy snowfall, outbreaks of infectious diseases, wars, civil wars, terrorism, riots, etc. (c) Orders to suspend operations by administrative or judicial organs
(d) When the problem is caused by a cause other than the Company's managed facilities
(e) When the problem is caused by a network or system that is not managed by the Company
(f) Third-party attacks and fraud
(g) For other reasons not attributable to the Company
(9) Limit of liability
Except in the case of willful misconduct or gross negligence on our part, we shall be liable for damages up to 100,000 yen for damages incurred by the user due to our breach of these Terms of Use or other non-fulfillment of our obligations related to this service.
(1)We will handle the personal information of users obtained in the provision of the Service for the purposes and within the scope specified in our Privacy Policy and Application Form.

(1)Subscriber represents and warrants that it is not now and will not in the future
(a) Boryokudan, Boryokudan-member, a person who has been a Boryokudan-member for less than 5 years, quasi-organized Boryokudan member, Boryokudan-related company, general meeting house, etc., socially motivated group, or special intelligence group, or any other person equivalent thereto (hereinafter such persons are referred to as "Boryokudan-member, etc.")
(b) A person who is in a relationship in which the operation of the building is controlled by a crime syndicate member, etc. or is recognized as being substantially involved in the operation of the building, or in any other relationship that is socially reprehensible.
(c) A person who is in a relationship with a Bouryokudanin, etc. that is deemed to be using the Bouryokudanin, etc. unjustly, such as for the purpose of pursuing unjust profits for oneself or a third party or for the purpose of harming a third party
(d) A person who is in a relationship that is recognized as being involved in the provision of funds, etc., or provision of favors, etc., to a Boryokudanin, etc.
(2)The user shall ensure that he/she or a third party does not commit any of the following acts
(a) Violent or unreasonable demands beyond legal responsibility
(b) Acts of threatening words or deeds, acts of using violence, or acts of damaging the other party's credibility or obstructing the other party's business by spreading rumors, using deceptive means or force
(c) Other acts equivalent to 19.(2)(a) or (c)
(3) When a user violates 19.1 (1) or (2), we may, without any notice, delete the user's ID, suspend the use of the service, and terminate the subscription agreement, and we shall not bear any responsibility for any damages incurred by the user as a result. The Company shall not bear any responsibility for any damages incurred by the user as a result of such termination.
(1)Copyrights, etc. for the Service, the Application and the Contents
Copyrights, trademarks, design rights, etc. (hereinafter referred to as "copyrights, etc.") related to the Service, the Application, and the Contents are the intellectual property rights of the Company or parties related to the provision of the Service (hereinafter referred to as "the Company, etc."). The intellectual property rights of the copyrights, trademarks, design rights, etc. (the "Works, etc.") related to the Service, the Application, and the Contents belong to the Company or any party related to the provision of the Service ("Company, etc."). The intellectual property rights of the design rights, trademark rights, etc. (hereinafter referred to as the "Works, etc.") belong to the Company or any party related to the provision of the Service (hereinafter referred to as the "Company, etc."), or their suppliers. Users may use the Application and works obtained through the Service only within the scope of private use permitted under the Copyright Law, Trademark Law, Design Law, and other related laws and regulations.
(2)Copyrights, etc. related to use of the Service and the Application
Copyrights (including rights under Article 27 and Article 28 of the Copyright Act) on suggestions, impressions, or other opinions ("Suggestions, etc.") submitted to the Service or this Application. Copyrights (including rights under Articles 27 and 28 of the Copyright Act) and all other rights related to the Service, comments, or other opinions ("Suggestions, etc.") All other rights to the proposals, comments, or other opinions (hereinafter "Proposals, etc.") received through the Service shall belong to the Company. Users shall not exercise their moral rights with respect to the Proposals, etc.
Users shall not engage in any of the following acts when using this application. In the event a violation is found, we may, at our discretion, delete the user ID pertaining to the user in question, suspend the use of this service, and terminate the usage contract.
(1)Any act that infringes or may infringe intellectual property rights or other rights of the Company or its suppliers.
(2) Unauthorized access to this application, unauthorized attacks, or actions that may lead to such attacks
(3)Any act that disables the provision of this service or transportation service, or otherwise interferes or may interfere with the operation of this service or transportation service.
(4)Any act that interferes or may interfere with the business activities of the Company or the business operators to which the Company outsources its services.
(5)Actions that cause or may cause disadvantage or damage to service providers or third parties related to this service.
(6) Criminal acts or acts that lead or may lead to criminal acts
(7)Any act of using any information obtained through the use of this application as a business, or any act of making such information available for use by a third party, regardless of the method used.
(8) Use of this application on a terminal other than a terminal compatible with this application (including a terminal that has been illegally modified to be compatible with this application) (9)acts of using this application on a terminal other than a terminal compatible with this application (including a terminal that has been improperly modified to be compatible with this application)
(9)Reverse engineering activities such as decompiling or disassembling this application
(10) Use of this application in combination with other applications or services

(14)Other than the above, acts that violate or may violate laws, regulations, or public order and morals
The Tokyo District Court shall have exclusive jurisdiction in the first instance over any disputes arising between the Company and users in connection with these Terms of Use.
These Terms and Conditions shall be governed by and construed and applied in accordance with the laws of Japan.
In the event that any matter is not stipulated in these Terms and Conditions or any question arises concerning the interpretation of these Terms and Conditions, the matter shall be resolved through good-faith consultation in accordance with applicable laws and regulations.
These Terms and Conditions will be effective as of April 1, 2025.
This service is provided as a demonstration experiment, and the demonstration period is from April 1, 2025 to March 31, 2026. During the demonstration experiment period, the service content, operating conditions, demonstration experiment period, etc. may be changed without prior notice based on the results of the experiment.
